Heard learned counsel for the petitioners. Notice on behalf of opposite party nos. 1, 2 and 3 has been accepted by the office of the learned Chief Standing Counsel.
The submission of learned counsel for the petitioner is that he is in the possession of the land in question. Initially the aforesaid land was recorded under the Imposition of Land Holding on Ceiling Act, 1960 in the name of the State.
This aspect of the matter was assailed by the petitioners by filing a Writ Petition before this Court which on on 02.08.2011 had passed the following order in W.P. No. 7634 of 2011 which reads as under:-
"Heard learned counsel for parties and perused the pleadings.
Learned State Counsel submitted that the case of petitioners would be covered by various orders already passed on the point in question, namely, that if the possession of land is not taken under Section 10(6) of the Urban Land Ceiling Act, the same shall not be taken. In para 7 of the writ petition as there is a specific averment to the effect that the possession of petitioners' land has not been taken, it shall not be taken in terms of the orders of this Court referred to here-in-above.
The writ petition is disposed of."
It is submitted that the petitioners thereafter have approached the Competent Authority for getting their name duly mutated but no action has been taken.
The learned Standing Counsel is directed to seek instructions and inform as to once the land is available to the petitioners why the mutation is not being done in their favour.
