Issue notice to opposite parties no. 8 to 13 to show cause why the petitoner be not admitted.
Notice on behalf opposite parties no. 1 to 6 has been accepted by the learned Chief Standing Counsel. Sri R.N. Gupta has put in appearance on behalf of opposite party no.7. They pray for and is granted four weeks' time to file counter affidavit. Two weeks' time thereafter is allowed to the learned counsel for the petitioner to file rejoinder affidavit.
List immediately thereafter.
Sri V.K.Singh learned counsel for the petitioner for the purpose of interim relief submits that the plot in dispute i.e. Gata nos. 49,107,108 and 115 which is situated in village Rewna, P.O. Madarbhari, police-station Bheeti District Ambedkarnagar belongs to the petitioner but they are wrongly allotted by way of patta by opposite party no.3 as such the petitioner has initiated the proceedings under Section 198(4) of the U.P.Z.A.& L.R. Act ,1950 ( Ram Sabad Singh and others Vs. Bihari and others). In spite of the pendency of the said proceedings, the petitioner, who is in possession of the aforesaid plots, is dispossed by the opposite parties.
In view the above said facts and in the interest of justice, the status quo as it exists today on the plot in question shall be maintained between the parties till the next date of listing or till the decision in Patta Cancellation Proceedings No. 178/206/228/237 under Section 198(4) of the U.P. Z.A.& L.R. Act , 1950 ( Ram Sabad and others Vs. Bihari and others pending in the Court of Additional Collector/ Additional District Magistrate (e) Faizabad whichever is earlier.
