Heard learned counsel for the applicant and the learned A.G.A. for the State and peruse the record.
The instant bail application has been filed for bail of applicant-Ram Ratan involved in Case Crime No. 1123 of 2018, under Section 302, 120B I.P.C., P.S. Kotwali Nagar, District Buland Shahar.
As per the prosecution case, the applicant has been named in the FIR for causing the death of two kids of the informant, aged about 5 years and 2 years, by slashing their throat.
Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated only because he is an elder brother of the son-in-law of the informant. Learned counsel further submits that no specific role has been assigned to the applicant and there is no independent eye witness of the occurrence. Applicant is law abiding person and languishing in jail since 4.9.2018. If he is released on bail, he will never misuse his liberty, terms and conditions of bail and will cooperate in the trial.
Learned A.G.A. has vehemently opposed the prayer for bail of the applicant submitting that the applicant is not entitled to be released on bail as the offence of murder of two children is very grievous in nature.
Considering the facts and circumstances of the case, without expressing any opinion on merit, I am not inclined to allow the bail application.
The bail application is, accordingly, rejected.
The trial Court is directed to expedite the trial and conclude the same expeditiously, preferably within one year from the date of production of a certified copy of this order subject to co-operation of applicant (accused).
Office is directed to send a certified copy of this order to the trial Court concerned for immediate compliance.
