Learned counsel for the petitioner is permitted to correct the typographical error which has occurred in the prayer clause of the writ petition.
Heard Sri V.K.Singh, learned senior advocate assisted by Sri H.P.Sahi, learned counsel for the petitioner and Sri Pankaj Kumar Srivastava holding brief of Ms.Sasmita Srivastava, learned counsel appearing for respondent No.4.
The petitioner claims that he retired as officiating Principal from an aided Intermediate college on 31.3.2017. It is submitted that the arrears of salary as well as the post retiral dues have not been given to the petitioner in spite of best of his efforts. The petitioner had also earlier filed a writ petition in which a direction was issued to the DIOS and the DIOS has passed an order with regard to the payment of pension and arrears of salary but the Committee of Management somehow or the other is resisting the same.
Sri Pankaj Kumar Srivastava holding brief of Ms. Sasmita Srivastava appearing for the Committee of Management submits that pursuant to the direction of the DIOS all the papers have been forwarded and the matter is pending at the level of the DIOS. However, learned counsel for the petitioner submits that it is only the Committee of Management which is delaying the payment to the petitioner only to harass him.
The writ petition is disposed of with the direction to the DIOS that in case the petitioner's claim is eligible, he shall ensure payment of retiral dues as well as arrears of salary to the petitioner. The said decision shall be taken by the DIOS within a period of two months from the date of filing of a certified copy of this order.
