Learned counsel for the petitioner by means of the instant petition assails the inaction of the respondents in failing to open the bid of the petitioner's firm Ram Raja Printers and Publishers and further seeks a direction in the nature of mandamus commanding the respondents to decide the application filed by the petitioner dated 02.04.2021 within time to be fixed by the Court.
Learned counsel for the petitioner submits that there are two firms with which the petitioner is undertaking its business. One of such firm was blacklisted by the department concerned in the State of Chhattisgarh. The petitioner No.1 firm which is not blacklisted had put in his bid with the respondent department for supplying text books, however, the bid of the petitioner No.1 is not being opened on the ground that other firm of the petitioner has been blacklisted in the State of Chhattisgarh.
Learned counsel for the petitioner further submits that so far as the other firm is concerned, the same has already challenged the blacklisting order before the High Court at Chhattisgarh, hence in the current scenario where the petitioner's firm is a separate entity, it is unfair on the part of the respondents not to open the financial bid of the petitioner.
Sri Sarvesh Kumar Dubey, learned counsel for respondents no.2 and 3 has pointed out that third party right has been created on 23.04.2021 and the said fact could not disputed by the learned counsel for the petitioner and at this stage he confined his prayer that his representation which is pending before the opposite party No.2 may be decided within time to be fixed by this Court.
Learned Additional Chief Standing Counsel submits that he has no objection in case an order directing the representation of the petitioner to be decided within time is passed by this Court.
In view of the aforesaid, this Court is of the view that ends of justice can be met by directing the respondent no.2 to decide the pending representation of the petitioner, if not decided already, within six weeks, in accordance with law, from the date an authenticated copy of this order is placed before the authority concerned.
With the aforesaid direction, the writ petition is disposed of.
The party shall file computer generated copy of order downloaded from the official website of High Court Allahabad, self attested by it alongwith a self attested identity proof of the said person (s) (preferably Aadhar Card) mentioning the mobile number (s) to which the said Aadhar Card is linked.
The concerned Court/Authority/Official shall verify the authenticity of the computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
