Heard Sri Chandra Shekhar Sharma, learned counsel for the petitioner and the learned Standing Counsel for the respondent nos. 1, 2, 3 and 5.
The petitioner in the writ petition is stated to be a member of the Gram Panchayat, Village-Harirampur, Block Deegh, District-Bhadohi. He and some other persons submitted a representation before the District Magistrate, Bhadohi with regard to misappropriation of gram sabha fund in the matter of "Shauchalaya Nirman Karya" upon which an enquiry report dated 02.11.2018 has been submitted, copy of which has been filed as Annexure no. 3 to the writ petition, in which a direction has been given by the Junior Engineer and "Apar Mukhya Adhikari" granting a month's time to 'Gram Pradhan' and 'Gram Panchayat Sachiv' to complete the said work but it is stated that more than two months have passed and nothing has been done till date.
No useful purpose would be served in keeping this writ petition pending.
This writ petition is therefore disposed of with a direction to the respondent no.3-District Panchayat Raj Officer, Bhadohi to consider and decide the petitioner's application / representation dated 23.08.2018 (Annexure no.1 to the writ petition) in accordance with law, expeditiously preferably within a period of one month from the date of receipt of the certified copy of this order in his office.
The petitioner alongwith a certified copy of this order shall also provide a copy of his representation dated 23.08.2018 to the respondent no.3.
It is made clear that the Court has not adjudicated the claim of the petitioner on merit.
