Heard learned counsel for the applicant.
From a perusal of the order sheet appended to these proceedings, it is evident that on numerous occasions, the matter could not be disposed of on account of the lawyers abstaining from work. On other dates, the competent authority did not take up the matter since he was engaged in administrative work. The Court notes that the direction of the writ Court was for disposal of the restoration application preferably within a period of four months.
In view of the above, this Court finds itself unable to hold the opposite party to be in contempt of the Court. This petition is therefore disposed of with a direction that the competent authority before whom the restoration application is pending shall ensure that the same is taken up and disposed of with expedition in accordance with law and without granting unnecessary adjournments. The competent authority shall also bear in mind the time frame originally stipulated by the writ Court.
