Heard learned counsel for the applicant and learned A.G.A for the State as also perused the record.
This application under Section 482 Cr.P.C. has been filed seeking direction to the court below for early decision of Case No. 3972 of 2016 (State Vs. Ram Nayan and others), arising out of Case Crime No. 1054 of 2015, under Section 323, 336, 504, 506, 308 I.P.C., Police Station Gauri Bazar, District Deoria, pending before C.J.M., Court no. 17, Deoria.
Without expressing any opinion on the merits of the case, this application is finally disposed of with a direction to the court below to decide the aforesaid case in accordance with law, without granting any unnecessary or long adjournments to either of the parties, as expeditiously as possible. It is further observed that though the trial was committed to the court of session, charges have yet not been framed in the last three years. The learned court below may make all efforts to complete the stage of framing of charge as expeditiously as possible, preferably within a period of three months from the date of production of a certified copy of this order, if there is no other legal impediment.
