Heard learned counsel for the petitioner.
This writ petition has been filed seeking the following relief:-
"(i) Issue an appropriate writ order or direction in the nature of mandamus commanding and directing the Tehsildar (Judicial) Rasda, Tehsil-Rasda, District Ballia to decide the petitioner's stay application filed along with restoration application bearing Restoration case No. 55 of 2019 (Computer Case No. T201915090401409), under section 209(h) of U.P. Revenue Code, 2006, Ram Pravesh Vs. Harindar and others, in mutation case No. 350/2019 (Computer Case No. T201915090400350) under section 34 of U.P. Revenue Code, 2006 Harindar Vs. Ram Pravesh, pending since 10.04.2019, within short stipulated time as fixed by this Hon'ble Court and till the disposal of stay application no third party shall be created by either of the parties. (Contained as Annexure No.8 to the Writ Petition)."
It is stated that a restoration application filed by the petitioner along with an application for stay is pending consideration since 10.04.2019.
Under the circumstances, this writ petition is disposed of with a direction to the respondent no. 1 to decide the stay application as expeditiously as possible, preferably within a period of four weeks from the date a certified copy of this order is filed before him.
It is made clear that this Court has not considered the claim of the petitioner on its merits nor has expressed any opinion thereon.
The respondent shall proceed with the matter strictly on merits after hearing concerned parties.
