JUDGMENT / ORDER

Heard learned counsel for the applicant and learned AGA for the State.
The main submission made by learned counsel is that the applicant is not named in the FIR, which was lodged on 10.10.2009 rgarding the incident of robbery, which is said to have been committed on 02.10.2009.
Next submission made by learned counsel is that the alleged money which is said to have been recovered from the applicant belongs to him, as he is farmer and the said money was kept in the house, which was taken from there by the police in collusion with the complainant and false case has been fabricated against the applicant on 27.10.2009.
I have given my thoughtful consideration to the submissions made by learned counsel for the parties. Although the incident of robbery is said to have occurred on 02.10.2009, but FIR was lodged after eight days on 10.10.2009 and recovery of alleged money is said to have been made on 27.10.2009 There is no criminal history of the applicant. Therefore, having considered all the facts and circumstances of the case, but without expressing any opinion about merit, the applicant may be admitted on bail.
Let the applicant Ram Parvesh alias Mohit s/o Ram Jeet Yadav be released on bail in case crime no. 1542 of 2009 under section 356, 379, 411 IPC, P.S. Ghoshi District Mau on his executing a personal bond of Rs.30,000/- and furnishing two sureties each in the like amount to the satisfaction of the court concerned.
