Heard Sri R.M.Tripathi, learned counsel for the petitioners and Sri G.P.Singh, learned AGA for the State.
Learned counsel for the petitioners submits that the petitioners had employed a Chaukidar in the rice mill and dacoity took place in the rice mill of the petitioners, in which the Chaukidar was assaulted for which he was medically treated by the petitioners, but he died subsequently.
Learned AGA has pointed out that the medical examination report of the deceased has not been annexed with the writ petition in order to show the cause of death of the deceased, to which learned counsel for the petitioners prays that the present petition be dismissed as not pressed with liberty to file fresh.
Accordingly, the present petition is dismissed as not pressed with liberty to file fresh.
Office is directed to return the certified copy of the F.I.R. to learned counsel for the petitioners after retaining a copy of the same.
