Heard the learned counsel for the applicant and perused the record.
This Court vide order dated 22.09.2010 had directed the court below to decide the Suit No. 125 of 1998 pending before the Court of Civil Judge (Senior Division), Kanpur Nagar, expeditiously by 31 July 2011.
It is urged that till date, the suit has not been decided.
On specific query, learned counsel for the applicant failed to show from the order-sheet brought on record that there is willful and deliberate disobedience of the writ court order on the part of the court below.
In the circumstances, contempt petition is disposed of with liberty to applicant to move an expedite application before the competent court.
