Heard learned counsel for the petitioner as well as learned Standing Counsel appearing for the State respondents and perused the record.
Pursuant to the order of this Court dated 19.4.2019 supplementary affidavit has been filed today, which is taken on record, stating therein that no application under Order 9 Rule 13 CPC was filed against the exparte order dated 18.5.2005 and decree dated 31.5.2005 passed by the trial Court in Suit No. 926 of 2004.
Present petition has been filed with a prayer that the respondent no. 1 be directed to expedite the hearing and decide the Execution Case No. 07 of 2005 (Ram Pratap Shahi vs. Brijesh Shahi) in Original Suit No. 926 of 2004 within a time bound period.
In the facts and circumstances of the case, the present petition is finally disposed of with the direction to the respondent no. 1 to expedite the hearing of the aforesaid case and decide the same on its own merit, in accordance with law, expeditiously preferably within a period of six months, provided there is no legal impediment and no unnecessary adjournments shall be granted to the parties.
With the aforesaid observations/ directions, the present petition is finally disposed of.
