JUDGMENT / ORDER

Court No. - 34
Case :- WRIT - A No. - 47079 of 2003 Petitioner :- Ram Prasad And Others Respondent :- State Of U.P. And Others Counsel for Petitioner :- Dr. G.S.D. Mishra Counsel for Respondent :- C.S.C.,N.K.Rastogi,S.A.Sharma
Hon'ble Sudhir Agarwal,J.
1. Called in revise. None appeared on behalf of petitioners.
2. By means of the present writ petition, petitioners have sought the following reliefs:
“(i) Issue a writ, order or direction in the nature of mandamus directing the respondent no. 2 to regularise the services of the petitioners as a Safai Karmchari under respondent no. 2. and pay the petitioners arrears salary of January 2003 to till today.
(ii) Issue a writ, order or direction in the nature of mandamus directing the respondent to pay the petitioners salary month to month when it became due and also release all consequential benefits for which the petitioners deserves for regularisation of their services.”
3. However, I have gone through the pleadings, grounds as also reliefs sought and find that petitioners are not able to make out a case so as to justify interference of this Court by granting reliefs, as prayed for.
4. Moreover, it appears that either the cause of action no more survives or that petitioners have lost interest in this matter or it has otherwise become infructuous and, probably for this reason, none is interested to have decided this matter on merits and that is why, counsel for petitioners is absent.
5. Dismissed. Interim order, if any, stands vacated.
