Heard Sri Rajiv Lochan Shukla, Sri Vinay Kumar Pathak, learned counsels for the applicant.
Learned counsel for the applicant submits that the applicant is falsely implicated in the Case Crime No 230 of 2015, Under Section 147, 148, 149, 302 and 506 IPC, Police Station Dhanari, District Sambhal.
Learned counsel for the applicant submits that the applicant is in jail since last more than four years.
During the course of hearing of the bail application this fact has been brought to notice of the Court by learned counsel for the applicant that the proceedings under Section 313 Cr.P.C. are commenced, however it is held up due to non availability of presiding officer.
Learned counsel for the applicant submits that since last about one and half month the Court concern is vacant.
In view of the aforesaid, this bail application is disposed of by directing the Court concern to expedite the proceedings, strictly in accordance with law, and decide the trial, after providing due opportunity to the respective parties, positively and preferably within a period of six months from the date of production of certified copy of this order.
It is open to the parties to move an expedite appropriate application before the learned District Judge for commencement of the proceedings and to appoint the appropriate Court for early disposal and for compliance of this order by the time framed.
Accordingly the application is disposed of.
