Heard learned counsel for the petitioner and learned Standing Counsel. Shri S.K. Verma appears for second and third respondent.
The petitioner is before this Court assailing the press release dated 19.03.2018 issued by third respondent so far it relates to calling the candidates for counselling, who have appeared in the earlier counselling and for a direction to the respondents to consider the candidature of the petitioner also in the counselling.
Shri S.K. Verma, learned counsel for the respondents raised an objection that so far as press release dated19.03.2018 appended as Annexure No.1 to the writ petition providing counselling to be held on 27.3.2018 is concerned, the said date has already expired and as such no relief can be extended to the petitioner.
Learned counsel for the petitioner in support of his submissions has contended that in similar circumstances this Court has passed interim order dated 15.3.2018 in Writ-A No.2709 of 2018 (Vinay Kumar Pandey & Anr. v. State of U.P. & Ors.) and similar indulgence may also be extended in favour of the petitioner. In this backdrop, learned counsel for the petitioner prayed that liberty may be accorded to the petitioner to move detailed representation in the light of the aforesaid interim order before the District Basic Education Officer, Farrukhabad for extending the similar benefit and the same may be directed to be decided expeditiously.
Considering the facts and circumstances of the case and without expressing any opinion on the merits of the issue, the writ petition stands disposed of with observation that in case the petitioner moves any such representation before the District Basic Education Officer, Farrukhabad within ten days, the same shall be considered and decided in accordance with law expeditiously and in case it is permissible the similar benefit as has been given in the aforesaid writ petition may also be extended to the petitioner.
