The sole prayer addressed on this petition is for the respondents being commanded to permit the petitioner to appear in the physical examination afresh. The prayer itself is addressed in the backdrop of a recruitment exercise which was initiated in 2011. Admittedly, the petitioners did not appear on the date when the physical examination test was to be conducted.
While the aforesaid recordal of facts would establish that the petition for all practical purposes had rendered infructuous, since learned counsel insisted upon arguing the matter on merits it may only be noted that the petitioner does not rest his case on any insurmountable circumstance beyond his control which would explain or condone his failure to take part in the test. The writ petition fails to lay any foundation in respect of the above. In any case, the Court finds no justifiable ground to reopen a chapter which relates to a recruitment which was initiated in 2011 and has undisputedly come to a close.
The writ petition shall stand dismissed Order Date :- 23.9.2021 Rakesh
