This Court has passed the order dated 21.08.2018 as under:-
"List revised.
None appeared for the revisionist nor any engagement slip has been given. This is a criminal revision of 2004 and the order-sheet reveals that the learned counsel has not appeared on the last date, therefore, this court was pleased to observe that the case shall be heard and decided on merit even in the absence of learned counsel for the revisionist.
Let a bailable warrant be issued against the revisionist executable by the Chief Judicial Magistrate, Rae Barely.
Chief Judicial Magistrate, Rae Barely is directed to grant bail to the revisionist when he appears before the court and shall ensure that the revisionist appears in person before this court on 7.9.2018.
Accordingly, list this revision on 7.9.2018."
It has been intimated by Sri Jagat Narain Dixit, learned counsel for the revisionist that in compliance of the aforesaid order, the revisionist, Ram Prakash Srivastava @ Dhunna, had appeared before the Chief Judicial Magistrate, Rae Bareli and accordingly he has been granted bail by the said Court. He is present in person before this Court and he is identified by his counsel Sri Jagat Narain Dixit.
List this case in the week commencing 17.09.2018.
On the said date, the revisionist, who is present today in the Court, need not be present unless called for. It is made clear that since this revision is of the year 2004, therefore, it shall not be adjourned on the next date.
