Court No. - 34
Case :- WRIT - A No. - 49279 of 2002 Petitioner :- Ram Prakash Singh Respondent :- State Of U.P. Through Secretary,Department Of Basic Edu.&Ors Counsel for Petitioner :- V.K. Singh,Ashok Khare Counsel for Respondent :- C.S.C.,Neeraj Tripathi
Hon'ble Sudhir Agarwal,J.
1. Called in revise. None appeared on behalf of petitioner.
2. By means of the present writ petition, petitioner has sought the following reliefs:
“a. a writ, order or direction of a suitable nature commanding the respondents to consider the petitioners for appointment as Assistant Teacher in Junior Basic Schools run by the Board of Basic Education in district Mirzapur treating the Teachers Training Qualification of Bachelor of Education Degree possessed by the petitioners as sufficient within a period to be specified by this Hon'ble Court;
b. a writ, order or direction of a suitable nature commanding the respondents to accord consideration to the petitioners for the post of Assistant Teacher in pursuance to the Advertisement issued by the Basic Shiksha Adhikari, Mirzapur as published in the newspaper “Amar Ujala” dated 3.11.2002 (Annexure-9 to this writ petition) and not to reject the application of the petitioners merely because they possessed Bachelor of Education Degree.”
3. However, I have gone through the pleadings, grounds as also reliefs sought and find that petitioner is not able to make out a case so as to justify interference of this Court by granting reliefs, as prayed for.
4. Moreover, it appears that either the cause of action no more survives or that petitioner has lost interest in this matter or it has otherwise become infructuous and, probably for this reason, none is interested to have decided this matter on merits and that is why, counsel for petitioner is absent.
5. Dismissed. Interim order, if any, stands vacated.
