Heard learned counsel for the petitioner and learned Additional Government Advocate.
The present writ petition has been filed against lodging of First Information Report relating to Case Crime No. 1591 of 2010 under Section 3 (1) 14 of the SC/ST Act of Police Station Sandi, district Hardoi.
We have gone through the contents of the First Information Report. Since the allegations made in the First Information Report disclose commission of cognizable offence, as such, the same cannot be quashed.
However, considering the trivial nature of allegations made in the FIR it is directed that the petitioner, who is Assistant Teacher, shall not be arrested in the above mentioned case crime number till cogent and reliable evidence comes forward against him provided he cooperates with the investigation which shall go on.
Subject to the above observations, the writ petition is finally disposed of.
