By means of the present writ petition, the petition has sought a direction for determination his seniority on the post of Executive Officer Class- IV in the Municipal Board under the centralized services with all consequential benefits, and has made a further prayer to decide his representation in this regard.
Smt. Archana Singh, Learned Additional Chief Standing Counsel appearing on behalf of the respondent nos. 1 and 2, has drawn attention of this court to the counter affidavit filed on behalf of the State respondents. In particulars reference is drawn to the averments contained in para 4 of the counter affidavit wherein it has been stated that the seniority list in question dated 29.01.1997, has been cancelled and vide the circular dated 07.09.2001 the final seniority list has been published and accordingly it is submitted that no further cause of action survives in the writ petition.
In view of the aforementioned facts and the circumstances, in particular taken into consideration the fact that the seniority list 19.10.1992 has been cancelled and the final seniority list has been published on 07.09.2001, no further relief can be granted as prayed for in the writ petition and it is accordingly dismissed.
