Hon'ble Alok Mathur,J.
1. Heard Sri Mohd. Aslam Khan, learned counsel for the petitioner as well as learned Standing counsel.
2. By means of the present petition the petitioner has assailed the order dated 30.7.2021 passed by Tehsildar, Tehsil Sadar, District Prayagraj thereby rejecting the application for mutaiton preferred by the petitioner.
3. Learned Standing counsel has raised a preliminary objection that the petitioner has equally efficacious remedy by way of appeal under section 207 of U.P. Revenue Code before Sub Divisional Magistrate concerned.
4. Learned counsel for the petitioner has fairly submitted that he may be relegated to the alternative remedy but prays that the appeal preferred by him may be directed to be disposed of expeditiously.
5. . Learned Standing counsel has no objection.
6. In view of above, present petition is dismissed on the ground of alternative remedy. It is, however, provided that the petitioner may be file an appeal before the Sub Divisional Magistrate concerned within three weeks from today and in case such an appeal is filed, the same shall be heard and decided expeditiously without giving any unnecessary adjournment, in accordance with law.
