Under the order dated 14.9.2017 in Writ A No. 37796 of 2017, filed by the applicant, liberty was granted to him to move a representation along with necessary documents and judgments of the Hon'ble Supreme Court as well as this Court before the competent authority for computation of services rendered by him in Auto Tractors Ltd. for the purposes of pensionary benefits. A further direction was issued that representation made in this regard shall be decided within a maximum period of three months from the date of receipt of certified copy of the order.
Learned counsel for the applicant points out that in terms or order of the writ Court representation along with certified copy of the order was sent to the opposite party on 6.10.2017 followed by reminder dated 14.5.2018 by registered post, but no action has been taken by the opposite party so far.
This Court is of the opinion that before inaction on part of the opposite party in complying with the above direction is treated as wilful disobedience of the order of the Writ Court, one more opportunity be granted to him to ensure compliance of the said order.
Accordingly, the instant contempt application is disposed of with liberty to the applicant to file a certified copy of this order along with fresh representation before the opposite party and in which event, he shall ensure that compliance of the direction issued by the Writ Court is made within next eight weeks. In case the compliance is still not made, as directed herein, it shall be open to the applicant to initiate fresh contempt proceedings against the opposite party.
