The writ petition has been filed for mandamus directing Member Secretary of District Administrative Committee (respondent-2) to immediately release arrears of salary of the petitioner as well as post retiral dues of the petitioner with interest for delayed payment.
It has been stated that the petitioner was appointed on the post of Cadre Secretary. During service period a departmental proceeding was initiated against him in which by order dated 14.7.2009 minor penalty was imposed upon him and an adverse remark was made in service record. The petitioner filed a department appeal against the order dated 14.7.2009 which was allowed by order dated 18.5.2010 and the matter was remanded to District Administrative Committee to decide the matter afresh after giving opportunity to the petitioner. Thereafter District Administrative Committee by order dated 2.8.2010 exonerated the petitioner from charges and reinstated in service with 50% back wages. The petitioner thereafter retired from service on 31.8.2010 but neither arrears of salary nor retiral dues was paid. The petitioner moved a representation in this regard which is pending before Member Secretary, District Administrative Committee respondent-2.
In the fact of the case the writ petition is disposed of directing Member Secretary, District Administrative Committee, respondent-2 to decide the representation of the petitioner by a reasoned order within a period of three months from the date of production of a certified copy of this order before him.
