Heard learned counsel for the petitioners and perused the record.
By means of this writ petition under Article 227 of the Constitution, petitioner is confining his prayer to the effect that a direction be issued to decide his 6-C application in a time bound period.
Learned counsel for the petitioner submits that defendants have appeared in the suit and yet the 6-C application has not been decided. He further submits that due to surge of pandemic (SARS COV-2/COVID 19), the application has remained pending and if the application is not decided at the earliest, the petitioner would suffer irreparable loss.
Accordingly, this petition is disposed of with a direction to the court concerned to consider and decide the 6-C application in O.S. No. 258 of 2020 (Rambabu Sharma and others v. Prem Narayan Sharma and Others), strictly in accordance with law and after recording satisfaction regarding service of summons and after giving full opportunity of hearing to the appearing parties, as expeditiously as possible preferably within a period of two months from the date of production of copy of this order.
It is provided that a copy of the order available on the official website of the High Court will be taken to be authentic one.
