By means of this application under section 482 Cr.P.C., order dated 28.08.2009 has been challenged whereby the complaint has been dismissed under section 203 Cr.P.C.
In my opinion, the impugned order can be challenged in the Revision under section 397 Cr.P.C. and hence power under section 482 Cr.P.C. cannot be exercised. The applicant counsel wants to argue on this point and wants to show some law. At this stage, the applicant counsel has made a request to grant him permission to convert the application into revision.
As prayed by counsel of the applicant, permission to convert the application under section 482 Cr.P.C. into revision is granted.
On converting the application into revision, put up on 18.01.2010 before appropriate Bench as fresh.
