Heard learned counsel for the applicants and learned AGA for the State.
The proceedings in complaint case has been challenged in the instant case.
Submission is that the complaint has been lodged as a counter blast after the lodging the first information report by the applicant.
Issue notice to opposite party no. 2 returnable at an early date. Counter affidavit may be filed within three weeks' from the date of receipt of notice. Rejoinder affidavit may be filed within three weeks' thereafter.
List after expiry of the aforesaid period before the appropriate Court.
Till the next date of listing, further proceedings of complaint case no. 3504 of 2009 (Govind Nishad Vs. Ram Nishad @ Bhagelu and others), under sections 323,452,354,504,506 IPC, police station Belipar District Gorakhpur pending in the court of Judicial Magistrate II, Gorakhpur shall remain stayed.
