The petitioner has filed this petition for a direction upon the bank to accepts the outstanding amount in installments excluding the recovery charges.
After hearing the learned counsel for the petitioner and perusing the averments made in the writ petition, we do not find any cause of action for the petitioner to file this petition as neither there is any recovery nor any other proceeding against the petitioner for realizing any outstanding amount. There is no application of the petitioner for even making the payment in installments before the bank.
In view of above, in our opinion, the writ petition is completely misconceived and is accordingly, dismissed.
After the order is dictated dismissing the writ petition, learned counsel for the petitioner submits that he may be permitted to withdraw the petition at this stage.
In view of the request so made, the writ petition may be treated to be dismissed as withdrawn.
