Heard Sri Lalit Kumar Mishra, learned counsel for the petitioner and learned Standing Counsel for the State.
The order assailed in the writ petition dated 18.7.2008 passed by the respondent no.3 directs the petitioner to vacate the official premises. It is asserted that the petitioner is not entitled to retain the official residential accommodation on account of his transfer from Varanasi.
In the writ petition the petitioner has specifically asserted that he has been transferred from Varanasi to Mirzapur. He is retaining the official accommodation at Varanasi since he is staying alone at Mirzapur. His family is still resides in Varanasi. It is asserted in the writ petition that the elder son of the petitioner is studying in Class XI and the younger son is in class V. Ten years have elapsed. The ground for retaining the accommodation does not exist any longer. In any case after the transfer from Varanasi the petitioner could not have retained the official residential accommodation at Varanasi. No subsequent developments are brought in the record. There is no infirmity in the order impugned.
The writ petition is dismissed.
