Heard learned counsel for the applicants.
The applicants who are all erstwhile employees of the U.P. State Cement Corporation, had sought extension of benefits flowing from the decision of the Supreme Court in Suneel Kumar Verma Vs. State of U.P. The writ petition preferred by them was disposed of with a direction for a representation being made to the Secretary (Karmik). It is however not disputed that the appropriate authority is the Secretary, Industrial Development arrayed in the writ petition as the third respondent. Even the representation appended at page-40 to the paper book is addressed to the Special Secretary in the Department of Industrial Development. However, presently there is no evidence on the record that this representation was in fact duly served upon the Special Secretary of the concerned Department.
Consequently, this petition shall stand disposed of with a direction that it shall be open to the applicants to file a detailed representation before the third respondent as arrayed in the writ petition within a period of two weeks from today. In case the same is preferred within the period aforementioned, the same shall be duly considered and disposed of by the concerned Principal Secretary expeditiously and preferably within a period of eight weeks therefrom.
