Heard learned counsel for the applicant as well as learned A.G.A.
The only prayer sought by means of the present application is that coercive measures issued by the court below against the applicant by way of N.B.W. dated 15.02.2021 onward may be kept in abeyance.
It is contended by learned counsel for the applicant that the applicant is ready to participate in the trial faithfully and sincerely.
Under the circumstances, on the solemn undertaking given by learned counsel for the applicant, coercive measures against the applicant dated 15.02.2021 and thereafter subsequent orders issuing non-bailable warrant are kept in abeyance for ten days from today.
The applicant is directed to surrender before the majesty of the court on or before 31.12.2021 and after being surrendered before court below, he shall be released on bail with two heavy sureties and in addition to this, he would give written undertaking that he would not seek any adjournment during trial.
Up to 31.12.2021, no coercive measures would be taken against the applicant.
The trial court is expected to gear up the matter and conclude the trial within a period of one year from the date of production of certified copy of this order strictly in accordance with law.
With the aforesaid observations, the present application stands disposed of.
