Heard learned counsel for the applicant and Sri Paras Nath Rai, learned counsel for the opposite party.
The applicant is before this Court for a direction to initiate contempt proceeding against the opposite party for wilful disobedience of the judgement and order dated 12.01.2021 passed in Writ Petition No.11596 of 2020 (Ram Nayan Vs. State of U.P. and 2 others).
An affidavit of compliance was filed by counsel for the opposite party, same is taken on record. It is stated in the affidavit of compliance that the order passed by the writ Court has already been complied with and decision has been taken on 22.10.2021, copy of which is appended as annexure 1 to the affidavit.
In this view of the matter, Court is of the opinion that the order passed by the writ court has been complied with, therefore, no cause of action remained survive.
In view of the same, the present contempt application is dismissed.
