Heard learned counsel for the petitioner and learned Standing Counsel for the State respondents.
In pith and substance, the petitioner is before this Court with the request to ask the respondent authorities not to allot the fair price shop of Gram Sabha Bariyakhas, Block Barhalganj, Tehsil Gola to seventh respondent namely Ram Das s/o Yamuna in pursuance of impugned resolution dated 19.11.2018 passed by Pradhan of the village.
At the very outset, learned Standing Counsel submits that the grievance of the petitioner can be very well looked into, examined and remedied by the Tehsil Level Committee headed by Sub Divisional Magistrate concerned.
In the facts and circumstances of the case, the writ petition, on consent, is disposed of with the direction that in case petitioner files a fresh complaint within ten days from today before the Tehsil Level Committee headed by Sub Divisional Magistrate concerned, the Authority concerned would proceed to look into the grievance of the petitioner and pass appropriate order within a period of six weeks thereafter but certainly after providing ample opportunity of hearing to the seventh respondent.
