Heard learned counsel for the petitioner and perused the record.
By means of this petition under Article 227 of the Constitution, the petitioner has prayed for following relief:-
"(i) direct the opposite party no. 1 to consider and decide the application under order 1 rule 10 C.P.C. and application under section 151 C.P.C. in re the Regular Suit for Permanent Injunction bearing No. 682/1999 Ram Adhar Vs. Ram Prasad & others contained as Annexure No. 1 & 2 respectively to this petition."
After some argument, learned counsel for the petitioner has confined his prayer only to the extent that his 6-C application may be considered and decided at the earliest.
Considering the overall facts and circumstances of the case, this petition is disposed of with a direction to the court concerned to conclude and decide the aforesaid 6-C application strictly in accordance with law and after recording satisfaction regarding service of summons and giving full opportunity of hearing to the appearing parties, as expeditiously as possible preferably within a period of 60 days positively from the date of production of copy of this order.
Copy of the order available on the official website of the High Court will be taken to be authentic one.
