Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.
The first bail application of the applicant was rejected by this Court vide order dated 3.6.2017 with a direction to the trial court to conclude the trial of the present case within one year from the date of production of a certified copy of this order which has not been concluded as yet, hence this second bail application has been moved on behalf of the applicant.
The new ground which has been argued by the learned counsel for the applicant is that in spite of the said order no witnesses of fact have been examined nor the trial has been concluded, hence the applicant may be released on bail, who is in jail since 7.4.2016.
Learned A.G.A. has vehemently opposed the prayer for bail and has submitted that the trial is in progress and first bail application of the applicant was rejected on merit by the Court.
Without expressing any opinion on the merits of the case and considering the submission advanced, I find no good ground for grant of bail to the applicant Ram Nath involved in Case Crime No.68 of 2016 under sections 302, 147, 148, 149, 34, 504 I.P.C., police station Maharajpur, District Kanpur Nagar.
Accordingly, the bail application is rejected.
However, the trial court is directed to expedite the trial of the aforesaid case and conclude the same within a further period of eight months from the date of production of a certified copy of this order.
