JUDGMENT / ORDER

Court No. - 7
Case :- WRIT - C No. - 42459 of 2018 Petitioner :- Ram Nath Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Neeraj Srivastava,Hari Mohan Srivastava Counsel for Respondent :- C.S.C.
Hon'ble Saumitra Dayal Singh,J.
1. Petitioner's application for renewal of arms licence is stated to be pending since 17.04.2018. At the same time, petitioner states that he has been convicted in a criminal case and awarded with life imprisonment. However, he has been enlarged on bail in the appeal proceedings, which are still pending.
2. In such circumstances, it has been submitted that the arms license of the petitioner ought to have been renewed since there are no pending proceedings either to cancel the arms licence or to suspend the same.
3. No useful purpose would be served in keeping the present writ petition pending any further or calling for counter affidavit. It is disposed of with a direction to the licensing authority to take note of the entire facts and circumstances of the case and act strictly in accordance with law with respect to the application filed by the petitioner seeking renewal of the arms licence. If the arms licence is to be refused, a reasoned order may be passed in that regard and further if any proceedings for cancellation or suspension of licence taken or are proposed to be initiated, the same may be done as expeditiously as possible, preferably within a period of three months from the date of production of a certified copy of this order.
Order Date :- 19.12.2018 Abhilash
