Heard Sri Gyanendra Pratap Singh, learned counsel for the petitioner and Sri Anil Babu, learned counsel appearing for Respondent No.1.
The present petition has been filed seeking a direction to the Civil Judge (Junior Division), Jaunpur to decide the 6-C application application in Case No. 740 of 2018 (C.N.R. No. UPJ P06003019-2018), Ram Nath vs. Dharmraj and another, which is said to be pending.
Counsel for the petitioner has placed reliance upon the order sheet of the case a copy whereof has been annexed as Annexure-3 to the petition to submit that notice has already been issued on the 6-C application and the defendants have filed their objections but for some reason or the other the matter is being adjourned. It is further submitted that the delay in disposal of the 6-C application is causing undue hardship to the petitioner.
In view of the aforementioned facts and circumstances, the present petition is disposed of with an observation that in case the petitioner appears before the court below and does not seek any unnecessary adjournment it is expected that the court below would make an endeavour to decide the 6-C application in the aforesaid case expeditiously in accordance with law provided there is no other legal impediment.
