The petitioner, who has retired from the post of Assistant Teacher at Swami Lilashah Adarsh Sindhi Inter College, Shahganj, Agra is aggrieved by wrong fixation of his pension. He claims that his continuous service since the date of initial appointment has not been counted for the purpose fixation of pension on account of the fact that for certain period, the Management contribution to the contributory of provident fund had not been deposited.
In support of his submission, learned counsel for the petitioner has placed reliance upon the judgment of this Court in Writ A No. 17819 of 2007 Mangali Prasad Verma Vs. State of U.P. and others. It has been informed that petitioner has already filed representation before the second respondent on 22.02.2018 and the submission is that the same may be directed to be decided within a specified time, to which learned standing counsel appearing on behalf of State-respondents does not have any objection.
Accordingly, the writ petition is disposed of by directing the second respondent to decide the representation of the petitioners dated 22.02.2018 in the light of law laid down by this Court in Mangali Prasad Verma (supra) by passing a speaking order within a period of next three months from the date of production of a certified copy of this order alongwith photocopy of the representation.
