JUDGMENT / ORDER

Hon'ble Mahendra Dayal,J.
Heard learned counsel for the parties.
With the consent of the parties' counsel the writ petition is disposed of at the admission stage.
The grievance of the petitioner is that his house situated in village Abadi 3490 and in new Abadi 3485 (cow shade) including others which are recorded as Abadi land in the revenue record. The opposite parties have raised unlawful construction in the public path way. The petitioner has moved an application before the opposite party no. 3 with the prayer to invoke jurisdiction under Section 133 Cr.P.C., but the opposite party no. 3 has not taken any cognizance on the said application.
Being aggrieved by the inaction of the opposite party no. 3, the petitioner has preferred the instant writ petition.
Accordingly without entering into the merits of the case writ petition is disposed of finally with a direction to the opposite party no. 3 to consider and decide the pending application of the petitioner on merits within a period of three months from the date of certified copy of this order is produced before him, after affording opportunity of hearing to the petitioner.
Accordingly, writ petition is disposed of.
