Petitioner is claiming regularisation under the 'U.P. Collection Peons Service (Second Amendment) Rules 2016. It is stated that he is continuing for the last nearly 24 years and in terms of the amended provision, his claim has not been examined so far. In respect of such grievance, petitioner has already approached the District Magistrate concerned. Submission is that though seniority list has been drawn in which the name of the petitioner is also included and committee has been constituted but no final decision is being taken.
Learned Standing Counsel submits that the grievance of the petitioner shall be examined, in accordance with law.
Considering the above, this petition stands disposed of, permitting the petitioner to approach the respondent no. 3 alongwith certified copy of this order within two weeks. The concerned respondent shall ensure that the petitioner's claim is examined with reference to rule 5(ii) of the Rules of 2016, in accordance with law, within a period of three months thereafter.
