The petitioner has preferred the present petition inter-alia with the prayer to direct the Civil Judge (Senior Division)/F.T.C., Jaunpur to decide the application No. 369C moved by the Plaintiff/Petitioner dated 22.05.2019 for dispossession of Respondent Nos. 13 to 16 from property marked 'Mad' "Kha" in the plaint filed in suit no. 34 of 1994 (Ram Narsh and Others Vs. Munni Devi and Others) within stipulated period.
It appears from the perusal of the records that an application being Application No. 369C was filed by the petitioner in the pending suit being Original Suit No. 34 of 1994 (Ram Narsh and Others Vs. Munni Devi and Others) on 22.05.2019.
It is argued that though considerable time has already been lapsed till date no decision has been taken on the same.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the Civil Judge (Senior Division)/F.T.C., Jaunpur to consider and decide the aforesaid application in accordance with law expeditiously and preferably within a period of four months from the date of production of self attested computer generated copy of this order downloaded from the official website of High Court Allahabad but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, if there is no legal impediment.
