Heard learned counsel for the applicant and learned A.G.A. for the State.
It is submitted by learned counsel for the applicant that the present matter relates to under Section 138 of Negotiable instruments Act, 1881 between the parties and the said matter can be well considered by Mediation Centre of this Court.
It is directed that applicants shall deposit a sum of Rs.10,000/- within two weeks' from today with the Mediation Centre of which 90% shall be paid to opposite party no.2 for his appearance before the Mediation Centre.
The matter is remitted to the Mediation Centre with the direction that the Mediation Centre shall conclude the mediation and conciliation proceedings expeditiously, preferably within a period of one month after giving notices to both the parties.
Thereafter the case shall be listed before appropriate Bench.
Till the next date of listing, further proceedings of Complaint Case No.6304 of 2016, under Section 138 of Negotiable Instruments Act, 1881, Police Station- Chandauli as well as summoning order dated 11.4.2017 passed by Chief Judicial magistrate, Chandauli shall remain stayed.
After depositing the amount, aforesaid, notices shall be issued to the parties and in case the aforesaid amount is not deposited within the aforesaid period, this application shall stand dismissed automatically.
