Heard Sri Rajesh Yadav, learned Advocate, brief holder of Ruchi Mishra, learned counsel for the petitioner, Sri Deepak Mishra, learned A.G.A. for the State and perused the impugned F.I.R. as well as material brought on record.
The relief sought in this petition is for a direction to the respondents not to harass the petitioner in Case Crime No. 466 of 2006 under sections 420, 467, 468, 471, 448 IPC, Police Station Chakeri, District Kanpur Nagar.
Learned counsel for the petitioner submitted that the petitioner was wanted in the present case which is of the year 2006 and has already obtained bail. Thereafter it was stated that the proceeding of the same has already been stayed by this Court. It was further submitted that the petitioner has no criminal antecedent but he is harassing by police personnel.
Learned A.G.A. raised a preliminary objection with respect to the prayer made in the present petition stating that for the relief sought in the present petition, the petitioner has alternative remedy.
Learned counsel for the petitioner could not satisfy the Court about the maintainability of the present petition.
Accordingly, the present petition is dismissed with liberty to the petitioner to avail the appropriate legal remedy available under the law.
