Heard learned counsel for the petitioner and Shri Tariq Maqbool Khan for the Gaon Sabha as also learned Standing counsel for the State-respondents.
The petition has been filed seeking the following relief-
"i) issue a writ, order or direction in the nature of certiorari mandamus directing the respondent no.1, i.e. Sub Divisional Magistrate/ Up Zila Adhikari, Tehsil Kasiya, District Kushinagar to decide the recall application dated 18.05.2018 to recalling the order dated 03.11.2017 in Case No.288 of 2017 "Computerized No.T-2017054465044268' (Ram Narayan Vs. Chandra Shekhar and others) under Section 24 U.P. Revenue Code, 2006 within stipulated period which this Hon'ble Court may deem fit and proper to the circumstances of the case."
Petitioner is aggrieved on account of pendency of a restoration application filed by the respondents seeking recall of the order passed on his application under Section 24 of the U.P. Revenue Code, 2006.
Under the circumstances, this writ petition is disposed of directing the respondent no.1, Sub Divisional Magistrate/ Up Zila Adhikari, Tehsil Kasiya, District Kushinagar to endeavour to decide the mutation case of the petitioner, expeditiously, preferably within a period of three months from the date a certified copy of this order is filed before him.
