Under challenge in the writ petition is FIR relating to Case Crime No. 229 A of 2009 under Sections 452, 323, 504, 316 IPC , Police Station - Umri Begum Ganj, district Gonda.
Heard learned counsel for the petitioners, learned AGA for the State of U.P. and perused the material on record including the impugned First Information Report.
The FIR discloses commission of cognizable offence, therefore it cannot be quashed.
Learned counsel for the petitioners submits that there are cross cases/ versions and at this stage, it is not ascertainable as to who was on the wrong footing.
In view of the above, it is provided that unless cogent and credible evidence is collected against the petitioners, they shall not be arrested during the investigation which shall go on. This order would be subject to full cooperation of the petitioners in the investigation.
The writ petition is finally disposed of.
