The applicants are before this Court for a direction to initiate contempt proceeding against the opposite party for wilful disobedience of the judgement and order dated 09.01.2020 passed in Writ A No.73 of 2020. The operative portion of the order is reproduced hereinbelow :-
"It is provided that the respondents shall make necessary deductions from the salary of the petitioners towards the G.P.F. fund which shall be subject to the final outcome of the writ petition. "
In paragraph 5 of the affidavit filed on behalf of the opposite party no.5, it is stated that pursuant to the order passed by the Writ Court on 09.1.2020 counter affidavit has been filed by the respondent-State.
In the circumstances, unless and until submission raised in the application seeking vacation is adequately addressed and rejected no case for initiation of contempt proceedings is made out.
In the circumstances, learned counsel for the applicant is directed to file rejoinder affidavit in the pending writ petition within three weeks. If the rejoinder affidavit is filed within three weeks, the Writ Court will consider and decide, at least the said vacation application filed by the opposite party in the writ petition, expeditiously and preferably within a period of four months.
In view of the same, present petition is disposed of.
