It has been pleaded on behalf of the petitioner that in de novo enquiry proceedings vide enquiry report dated 19.2.2008, a sum of Rs. 98,541.67 is said to be embezzled by the petitioner. Till date, no decision has been taken by the disciplinary authority/administrative committee without which no recovery can be effected from the petitioner.

It has been pointed out that the petitioner has already filed objections re: the mode of enquiry to the Board of Enquiry.

Learned counsel for the respondent prays for one week's adjournment to take instructions and file short affidavit or counter affidavit.
