List revised. Case called out. No one appears on behalf of the petitioner to press this writ petition.
Learned standing counsel representing the State-respondents is present.
In paragraph 3 of the writ petition it is stated that petitioner was initially appointed as Lekhpal on 1.08.1972 and after completing the age of superannuation he retired from service on 31.07.2009. In paragraph 4 of the writ petition, the petitioner has stated that similar situate employees are getting the benefit of Government Order dated 30.06.1989 and 05.02.1997 with regard to revised pay scale etc. but the said benefit has not been extended to the petitioner. It appears that the petitioner has died on 30.11.2015. He was substituted by heirs and legal representatives, namely, the petitioner Nos. 1/1, 1/2 and 1/3. The relief sought in the writ petition is that the claim of the petitioner for revised pay scale etc. be decided by the competent authority within a time bound period.
Learned standing counsel points out that an order dated 6.7.2012 was passed by the respondent no.2 whereby the claim of the petitioner for selection grade and super selection grade was rejected.
Be as it may. This writ petition is disposed of giving liberty to the petitioner to raise all his grievances before the respondent no.2 within four weeks from today alongwith a certified copy of this order and in the event such a representation is made within the stipulated period, then the respondent no.2 shall decide it in accordance with law within a further period of three months.
It is made clear that this Court has not expressed any opinion on the merits of the claim of the petitioner.
