This application under Section 482 Cr.P.C. has been filed for quashing the order dated 28.3.2018 passed by the Additional District Judge/F.T.C. Court No. 28, Deoria in S.T. No. 275 of 2014 (State vs Sri Kishun and others) arising out of Case Crime No. 451 of 2014 under Sections 147, 148, 302, 436, 34 of IPC, P.S. Madanpur, District Deoria.
The applicant moved an application (100kha) during cross- examination contending that the arms and ammunition were not produced by the Investigating Officer. The trial court has rejected the application stating therein that it is upon the prosecution to prove its case and to produce the evidence at any stage during the course of prosecution witness being examined.
Learned counsel for the applicant failed to point out any illegality, infirmity or perversity in the impugned order.
The petition being devoid of merit is, accordingly, dismissed.
