In view of the order proposed to be passed, notice need not issue to the private-respondents.
The petitioner has preferred the present petition under Article 227 of the Constitution of India with the prayer to direct the Civil Judge (Junior Division) Shahjahanpur to decide the Misc. Application No. 119 of 2017 filed in Original Suit No. 477 of 2014 (Ram Murti vs. Raj Kumar @ Raju & Ors) within stipulated period.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the Civil Judge (Junior Division) Shahjahanpur to consider and decide the aforesaid application in accordance with law expeditiously and preferably within a period of three months from the date of production of self attested computer generated copy of this order downloaded from the official website of High Court Allahabad but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, if there is no legal impediment.
